Terms of Service

1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of the Golden Wealth website, platform, and related services (collectively, the “Service”). By creating an account, accessing the Service, or clicking to accept these Terms, you agree to be bound by them. If you do not agree, do not use the Service.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement.
We may update these Terms from time to time. If we make material changes, we will notify you by email and/or through a notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
2. Description of Service
Golden Wealth is a secure estate management platform that helps individuals and families organize estate-related documents, track financial accounts, manage contacts, and share information with trusted people. Features include: document storage, financial account tracking, Plaid-powered bank account linking, the Will Builder, notes, contacts, reminders, member access management, and an Audit Log.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial estate management purposes, subject to these Terms.
3. Account Registration
To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You agree to:
- Keep your account credentials secure and not share them with others.
- Notify us immediately at support@live-golden.com if you suspect unauthorized access to your account.
- Keep your profile information current and accurate.
You may only create an account on your own behalf. You may not create an account on behalf of another individual without their authorization.
4. Important Disclaimers — Not Legal or Financial Advice
A. Not a Law Firm; No Legal Advice
GOLDEN WEALTH IS NOT A LAW FIRM AND DOES NOT PROVIDE LEGAL ADVICE. The Will Builder and any other document-generation features of the Service produce self-help templates intended to help you organize and express your wishes. These documents are not a substitute for the advice of a licensed attorney. No attorney-client relationship is created through your use of the Service.
The documents generated by the Will Builder may not be legally valid in your state or jurisdiction. Legal validity depends on proper signing, witnessing, notarization, and other formalities that vary by state law. Golden Wealth has no responsibility for the notarization, signing, witnessing, recording, filing, or any other steps required to make your documents legally effective after you download or print them. You are solely responsible for verifying that any document you create complies with the laws of your jurisdiction and for working with a licensed attorney if you have specific legal questions.
B. Not Financial Advice
GOLDEN WEALTH DOES NOT PROVIDE FINANCIAL, INVESTMENT, TAX, OR ACCOUNTING ADVICE. Financial account information displayed in the Service (whether entered manually or retrieved through Plaid) is provided for organizational and informational purposes only. We cannot guarantee the accuracy, completeness, or timeliness of third-party data. You should consult a licensed financial advisor, CPA, or other qualified professional for advice specific to your situation.
C. Not a Backup Service
While we take reasonable measures to protect your data, Golden Wealth is an estate management tool, not a certified backup or disaster-recovery service. You should maintain independent copies of important documents and not rely solely on the Service for document preservation.
5. Subscription Plans and Billing
A. Plans and Fees
Certain features of the Service require a paid subscription. Current plan details and pricing are available on our Pricing page. We reserve the right to change plan features and pricing at any time with advance notice to current subscribers.
B. Automatic Renewal
SUBSCRIPTIONS AUTOMATICALLY RENEW AT THE END OF EACH BILLING PERIOD UNLESS YOU CANCEL BEFORE THE RENEWAL DATE. By purchasing a subscription, you authorize us to charge the payment method on file for the applicable subscription fee at the start of each billing period. If your subscription has a term of one year or longer, we will send you a renewal notice at least 15 days before the renewal date.
C. Cancellation
You may cancel your subscription at any time through your account settings or by emailing support@live-golden.com. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period for which you have paid.
D. Refunds
All fees are non-refundable except as required by applicable law or as we determine in our sole discretion. Cancellation does not entitle you to a prorated refund for the unused portion of the current billing period.
E. Free Plans
We may offer a free tier with limited features. We reserve the right to modify the features included in the free tier at any time.
6. Your Content and Data
A. Ownership
You retain ownership of all content you upload, create, or store in the Service (“Your Content”), including documents, notes, financial account records, contacts, and Will Builder responses.
B. License to Us
By using the Service, you grant Golden Wealth a limited, non-exclusive, royalty-free license to store, reproduce, and process Your Content solely as necessary to provide the Service to you. We do not use Your Content to train machine learning models, and we do not share Your Content with third parties except as described in our Privacy Policy.
C. Your Responsibilities
You represent and warrant that:
- You have all rights necessary to upload and share Your Content through the Service.
- Your Content does not violate any applicable law or infringe any third-party rights.
- You will not upload malware, viruses, or other harmful code.
D. Data Export and Deletion
You may request an export of Your Content at any time by contacting support@live-golden.com. Upon account deletion, your data will be removed from our systems as described in our Privacy Policy.
7. Estate Members and Shared Access
You may invite other people (“Members”) to access your estate with permissions you specify. By inviting a Member, you:
- Authorize that Member to access the portions of your estate permitted by the permissions you assign, including any documents, accounts, contacts, and notes within those sections.
- Accept responsibility for your decisions about who to invite and what permissions to grant.
- Acknowledge that once a Member accesses your content, you cannot undo that access retroactively, though you can revoke permissions going forward.
Golden Wealth is not responsible for how Members use the information they access within your estate, consistent with the permissions you have granted. You should only invite people you trust.
8. Plaid Bank Account Linking
If you use our bank account linking feature, you will be connecting to Plaid’s services. By initiating a Plaid connection, you agree to Plaid’s End User Services Agreement and End User Privacy Policy. Golden Wealth is not responsible for Plaid’s services, data practices, or the accuracy of financial data retrieved through Plaid.
You may disconnect any linked bank account at any time. Upon disconnection, we will delete the corresponding access token and request deletion of your data from Plaid’s systems.
9. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to any portion of the Service, another user’s account, or our infrastructure.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Scrape, crawl, or use automated methods to extract data from the Service.
- Upload or transmit malware, viruses, or any other harmful code.
- Use the Service to impersonate another person or entity.
- Interfere with or disrupt the integrity or performance of the Service.
- Build a competitive product or service using information obtained from the Service.
- Use the Service to store or process information on behalf of third parties as a bureau or service provider without our written consent.
10. Intellectual Property
The Service, including its design, features, software, and content (excluding Your Content), is owned by Golden Wealth and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service or its content without our prior written permission.
“Golden Wealth,” the Golden Wealth logo, and related marks are our trademarks and may not be used without our prior written consent.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion. You may terminate your account at any time by contacting support@live-golden.com.
Upon termination, your license to use the Service ends immediately. Sections 4, 6, 12, 13, 14, and 15 of these Terms survive termination.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL GOLDEN WEALTH OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU TO GOLDEN WEALTH IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.
14. Dispute Resolution; Binding Arbitration
A. Informal Resolution
Before initiating any formal dispute, you agree to contact us at legal@live-golden.com and provide a written description of the dispute, the relief sought, and your contact information. We will attempt to resolve the dispute informally within 30 days. If we cannot resolve it informally, either party may proceed to arbitration as described below.
B. Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration will be conducted in San Francisco, California (or by video conference for disputes not exceeding $10,000). The arbitrator’s award will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
C. Class Action Waiver
YOU AND GOLDEN WEALTH EACH AGREE THAT CLAIMS AGAINST THE OTHER MAY ONLY BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING.
D. Opt-Out Right
You may opt out of this arbitration agreement by sending a written notice to legal@live-golden.com with the subject line “ARBITRATION OPT-OUT” within 30 days of the date you first agreed to these Terms. Opting out does not affect any other provision of these Terms.
E. Exceptions
Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or unauthorized access to the Service.
15. General Provisions
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. For disputes not subject to arbitration, you consent to the exclusive jurisdiction of courts located in San Francisco County, California.
Indemnification
You agree to defend, indemnify, and hold harmless Golden Wealth and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Golden Wealth regarding the Service and supersede all prior agreements.
Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
No Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights under these Terms without restriction.
Force Majeure
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, acts of government, power outages, or internet disruptions.
